Alert: New I-9 Form available

The U.S. Citizenship and Immigration Services (USCIS) has made available the revised Form I-9.

As described in our January 9 story, “New I-9 deadline Feb. 2: Are you ready?” The USCIS has published an interim final rule that narrows the list of documents employers may accept to verify employment authorization on the I-9 form. The revised Form I-9 becomes effective on February 2, 2009. At that time, employers will be required to use only the new form to verify the employment eligibility of new hires and reverify existing employees where necessary.

USCIS has published a final version of the I-9 form, a copy of which is available here, along with instructions.

The current version of the I-9 form, dated June 5, 2007, will no longer be available after the interim final rule takes effect on February 2, 2009.

    The American Immigration Lawyers Association (AILA) has asked the US Citizenship and Immigration Service to delay the effective date of the new I-9. If there is a delay, I’ll post another comment to this effect.

    The effective date of the new I-9 has been delayed for 60 days, to April 3, 2009.

    You’re linking to the old I-9 form. The new one doesn’t accept expired US passport.

    I was aware of the new I-9 which was to take effect today (02/02/09) but the USCIS website has changed. It now says 04/03/09. Do you know what is happening with this issue?

    The USCIS has extended the ruling until 4/3/09. The new form is not available on their site as of yet.

    Wonder why they went back to the 06/05/07 version and not the 06/16/08 version?

    There is a delay due to the new rule of no longer being able to accept expired documents. They opened it up for public comment on the matter. So if anyone wants to throw in their 2 cents nows your chance!
