As long as the person making the hiring decision does not have access to such survey. If he/she does it would be the same as writing the gender/race/religion etc as notes on the resume or related documents, and lead to the same hot water as mentioned in the report.

Recommendation – a Voluntary Applicant Self-Identification Survey attached to your company’s application is the legal, safe way to go and will give that information
