Employee sues over test OK’d by Supreme Court

A recent Supreme Court case now has a new element of confusion.

The Supreme Court recently ruled on a case involving employees at a fire department in Connecticut. To be considered for a promotion, the employees had to take a written and oral test. Candidates with the best scores were chosen.

A group of African-American firefighters complained that the test was biased, so the department threw out the results and started from scratch.

However, the white employees who would’ve been promoted based on the test scores sued. The Supreme Court agreed, ruling the department threw out the results of a perfectly good test.

Now, an African-American employee has filed his own suit. He’s claiming the test really was biased, and that he was unfairly denied a promotion when the policy on the test was reinstated.

Got that? We’ll keep you posted on how the suit proceeds.

One thing these cases show: Employment tests can be complicated. Companies should track results to look for signs of a disparate impact.

    Frankkinney-
While I agree a great deal with what you are saying, your thoughts are not very well organized. Your post seems to be a rambling on of your ideas. The entire post just doesn’t flow well. Sorry. But yes, the minority voices seem to be louder than the majority. It’s like the latter doesn’t even have a voice any longer.

I agree somewhat with Frankkinney, I don’t like that people feel they should be promoted over someone else just because of their race. However, I have to wonder if you would have passed a written compentency test. I agree when the previous writer said that you are rambling. I think that you would be more effective in making your point if it were written in clear and concise sentences. By the way, the speech says, “I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character.” There is certainly a difference between judging by the character and the CONTENT of the character. I would hope that one day this would be in effect, but alas, it is not so.

Take a breath Frakkinney, your points are strong but your delivery is confusing. Anytime we decide one group should get special treatment over another, it’s wrong. Everyone needs to start accepting success or failure based on their individual performance and deal with it. Until we can get past the wrongs of our fathers and learn to forgive we will be destined to commit the same mistakes again and again.

I get the impression that Frankkinney is from California. I too am from California and we’re all starting to ramble like that! We have to put up with the likes of Feinstein and Boxer and the idiot judges that overturned our vote to stop catering to illegal aliens and paying for all of their needs. (Yes, I call them ILLEGAL ALIENS because that’s what they are!) I can’t blame him for being bitter and writing like a frustrated, crazed person because we in California are sick and tired of being beaten down by the minorities. It never was hate before but since they started shoving it down our throats, it has become overwhelming. AND THERE’S NOTHING WE CAN DO ABOUT IT!
