When a group of immigrant workers in Washington State sued their employer for FLSA violations, the company tried to get the lawsuit thrown out. Was it successful?
What happened
The company argued that the employees were “illegal aliens,” and therefore weren’t protected under the Fair Labor Standards Act (FLSA).
But the court ruled that didn’t matter. The FLSA is meant to protect all employees — regardless of immigration status — from abuse.
So the company lost its fight to get the case thrown out.
