Pay for Jury Duty: New Compliance Obligation in Illinois
Gov. J.B. Pritzker signed HB 4844, requiring Illinois employers with more than 25 employees to pay workers their regular rate of pay for time serving on jury duty. The law takes effect Jan. 1, 2027.
Before this law, Illinois already required employers to give employees time off for jury service, along with notice and anti-retaliation protections. HB 4844 adds a pay requirement to those protections.
Employees must still provide their employer with a copy of the jury summons within 10 days after it is issued. Employers still cannot discharge, threaten to discharge, intimidate or coerce employees because of jury service. An employer that violates the law may be liable for lost wages and benefits as well as attorney fees. It may also be enjoined and ordered to reinstate a discharged employee.
Takeaway: Update payroll practices, handbooks and leave policies before Jan. 1, 2027, and provide training on the new compliance obligations.
