Baristas Awarded $1.86M Over Employer’s Cash-Pay Scheme
Informal cash-pay practices leave wage payments and hours worked outside normal payroll controls. Case in point:
A Washington state court ordered Alan Tagle and Tagle & Partners LLC to pay $1.86 million to 70 former Beehive Espresso baristas in a wage-and-hour class action. The award includes:
- $631,352.74 in unpaid wages
- $981,352.74 in statutory damages, and
- $250,005.22 in prejudgment interest.
Attorneys’ fees and costs have not yet been set, and the judgment will continue to accrue interest.
According to the employees’ attorneys, Tagle did not issue paychecks or pay stubs, track hours or maintain payroll records. Instead, they said, baristas were told to take wages and tips from the till. The court found Tagle and his company liable for Washington wage-and-hour violations, including minimum wage violations, paid sick leave violations and tip theft.
