DOL: Restaurant Owes 31 Workers More Than $732K in Overtime, Minimum Wages
Paying employees a “monthly salary” doesn’t automatically shield employers from wage and hour compliance obligations required under the federal Fair Labor Standards Act (FLSA), as a recent six-figure settlement shows.
A recent Department of Labor (DOL) investigation determined a Florida restaurant failed to pay workers all wages they were owed.
According to the DOL, Lucky King LLC – a seafood restaurant operating as Miyako Japanese Buffet – paid most of its employees a monthly salary, ranging from $1,000 to $3,000, despite the fact that they typically worked more than 40 hours per week. Investigators also found the employer failed to pay minimum wage for all hours worked and failed to maintain required records, violating the FLSA.
The employer agreed to pay $732,976 for 31 affected workers.
